Abstract

 

This article examines the relationship between two key institutions within the alternative dispute resolution (ADR) framework: public policy and mediation. Drawing upon the legislation of the Republic of Uzbekistan and international practice, the author analyzes the role of public policy considerations in the recognition, enforcement, and implementation of mediated settlement agreements. The study also explores the connection between state policies on mediation and the principles of public policy in foreign jurisdictions. Particular attention is given to the extent to which public policy serves as a safeguard in mediation while preserving the flexibility and effectiveness of consensual dispute resolution mechanisms.
